Kimo -- Good point -- couldn't use the name "in business." For someone to be violating your trademark, they have to be actively impinging on your business - either making money from your intellectual property or good will, or losing you money. If people are just taking your name in vain (whether government records or anywhere else), there's nothing you can do. You can't even protect yourself against bad product reviews, whether that would cost you money, because people aren't directly profiting from your trademark -- their product, product reviews, isn't likely to be confused with your product (unless you happen to be in the product review business yourself and they're branding their own product reviews with your name).
