Hi David,
I don't have a serious reply regarding your trademark question, just a  
somewhat funny anecdote...
Remember Wally "Famous" Amos, who sold his cookie company and couldn't  
use his name in business anymore.
He later came out with another brand of cookies called, "Uncle Noname".
