1. The FCC has jurisdiction over anything that connects to the telephone
lines. They also have compliance rules for most things that might radiate
radio interference. Here, if a device contains an oscillator that operates
over a frequency of 9 KHz, the device must comply with some section in Part
15 of their rules.

Almost all "switching" power supplies and most digital circuits contain
circuity that operates far above 9 KHz.

2. The FCC rules are designed to prevent the advertising, importation and
sale of un-approved devices. Enforcement is another issue. 

Congress hopes the FCC will net $20B with the doom of standard TV
broadcasting in Feb, 2009, and the sale of frequencies in the 700 MHz band.
But will Congress return $$ for the FCC Enforcement Division? Doubtful.

Enforcement of "importation" of unapproved devices has been passed on to
the Customs Service. Enforcement of unapproved electronic devices is not a
hot topic there either.

3. So, is the sale of unapproved devices possible? I had one client tell me
that because his original circuit was a copy of a Radio Shack circuit (that
had an approival) his was also approved. And his new circuit was "most
likely" approved, also.

Each and every telephone device sould have a statement on it. Every
'wireless' device must have an FCC ID number on the device (in 8 point, or
larger, type). Go look for these.

Don't know,  probably not but VoIP doesn't need FCC Approval

Yes,  the FCC has jurisdiction over all things Internet.  State level  
agencies like the Mass DTC do not have jurisdiction over VoIP.  That  
is why anyone and their brother can become a VoIP provider but only a  
registered CLEC can be a phone provider.

The FCC does have mandates for ITSP (Internet Telephony Service  
Providers) that require 911 functionality and CALEA (wiretapping)  
support.
