Afranio, I am not a lawyer and yet I have successfully applied for and received trademark approval for a logo by filling out the required government forms and following the rules (e.g., selling goods/services with the mark in other states). As I understand it, your client's logo mark is protected by using/establishing it (you can put TM next to the mark until you apply for a registered trademark). The most difficult part in my view is determining the classifications for the business. So as others have, I recommend using an experience trademark lawyer. As I understand it, you can only protect the logo in business categories that are related to the products and services it is associated with (for example, IBM is only protected in computer-related fields, not food and beverages). How you make those associations is important. So that's where an attorney who specializes in trademarks can be helpful to get the most and the right protection. Equally important is knowing how to use a trademark...always as an adjective (not a possessive or a noun). I was told once that Kleenex nearly lost the right of trademark because Kleenex almost became synonymous with tissue. "Hand me a Kleenex." Now you only see "Kleenex tissue" or "Kleenex brand tissue." I don't want to get burned later because of something might be missing. I don't think he wants to use a lawyer, I personally would.
