the domain to another account has triggered the "no transfer for
60 days" ICANN rule, so between that and not having access to the
contact email means you probably can't transfer it for a while. I
would pursue continued conversations with namecheap (maybe you can
escalate to someone who is more reasonable), as well as Rich's
recommendation of the About Lost Domain Names processes he linked

I have to say, in my experience register.com is the most expensive
of the large registrars and they do every nasty thing they can to
prevent domains from transferring out, I'd strongly suggest
avoiding them. Typically, domain.com comes out on top of best
registrars, their domains are $10 compared to register.com's price
was $35 back when they posted it, and they've now made it much
harder to find out how much renewals are (they offer a cheap first
year to suck you in) but you can be sure it's $35 or more. Other
add-ons like domain protection are similarly super expensive.
Network Solutions is almost as bad, although my experience is that
they've stopped trying so hard to prevent transfer outs in the
past few years. <br>

contact person / owner information for their domain.<o:p></o:p></p>
<p class="MsoNormal">They use “namecheap.com” (guess the name
tells you what you get)<o:p></o:p></p>
<p class="MsoNormal">Anyway,<o:p></o:p></p>
<p class="MsoNormal">The person who setup the domain years
ago, is no longer with us and there is no way to contact
this person.<o:p></o:p></p>
<p class="MsoNormal">The client’s domain registration ran out,
they had no email and no domain access.<o:p></o:p></p>
<p class="MsoNormal">I was able to open an account in my name
with “namecheap”, pay the domain fee for this domain, now
they get emails and access to their website.<o:p></o:p></p>
<p class="MsoNormal">So, they let me pay for the domain
registration, but won’t let me or my client change the
contact information without talking to the original owner.<o:p></o:p></p>
<p class="MsoNormal">“namecheap” did say we could take legal
action. (What?, do we take “namecheap” to court?, do we take
the original owner, that we can’t reach, to court?
“namecheap” doesn’t have any answers)<o:p></o:p></p>
