ok, 1st off there is no 'not used' not really -- it's registered or not 
-- squatter is not  a legal distinction.

As for registered trademark -- that is a policy, that you can find at:

We have been a domain reseller for over 10 years, and have not needed to 
use legal means, remember
depending on who has registered the domain, it might be cheaper to buy 
it back then lawyer's fees.

Without knowing the domain, I can't be of more help.
