Whatever the argument it helps to contest the ticket if only to plead it down to a lesser charge before the case is heard by the judge. I remember one ticket I got they just let me donate money to charity and they made it a non-moving violation. This of course only works if you have a clean record to begin with and you were not doing anything too crazy.
