Without an agreement stating such it really becomes very fuzzy. We will always give a client their website if they want to move, because if someone wants to work with someone new, that means we didn't do our job in supporting them. Trust me has only happened a couple times to us. :) Some designers/developers aren't as nice and don't realize the negative impact it can have on future referrals. We have a couple people that have left but only because someone offered to help them for free. Then years later have come back because we are open and willing to give people their stuff.
