I haven't had to do this, but my guess is approaching the squatter, or having a broker do so, up front to see if they are willing to sell may be cheaper than following the UDRP protocol. Many squatters will be glad to sell unless they, too, are planning to use this new trade name, and they could push for a larger negotiated fee if they know you have the resources to follow the protocol. If you don't already have the trademark and brand in use, and you suspect the owner of the domain may actually be starting a business using the name, you should be careful to get your legal ducks in order before you approach them even through an anonymous broker, or it may be you that is prevented from using the name! As well, simply using something like GoDaddy's domain backordering service can get you a domain you want that is about to expire. I got townwebsites.com and townwebsites.net using that service after I'd started out with townwebsites.us. At the time I wouldn't have been willing to put up funds for a premium name purchase, but the squatters on those names seemed not willing to pay another year's fee to see if they could get a higher bid. Maybe there is an expert on here who knows how best to approach this, if not, a search on domain name broker shows a number of businesses you can review to get an idea of the terrain.
