Aurangzeb, I think your house-painter may not fully understand the new law, and may have a chance to save his business. Two important facts: 1) the new law only requires employers to establish Sect 125 Cafeteria Plans if they have 11 or more employees 2) the law allows "employee-pays-all" plans for part-time and contract employees. So, if your house painter has 10 or fewer employees then there is nothing to do. If he has > 10 employees but employs them on a part-time or contract basis, which I'd expect for a house-painter, then he still has to establish a Sect 125 plan which is a time-consuming hassle, but not that expensive.
